Clickwrap Incorporation Notice

This document is incorporated by reference into Shift Elevate subscription agreements via clickwrap acceptance on the order form.

1. Scope and Purpose

This Privacy Policy explains how Shift Elevate collects, uses, shares, and protects personal information in connection with our healthcare workforce scheduling platform.

This policy applies to customer administrators, staff users, and other individuals whose information is submitted through the platform.

2. Information We Collect

We collect information that is needed to provide and secure the service, including:

  • Account data (name, work email, role, login credentials).
  • Operational data (facility details, schedule assignments, staffing preferences).
  • Contact data (phone number and email for transactional notices).
  • Technical data (IP address, browser/device metadata, audit logs).

3. How We Use Information

We use personal information to operate and improve the service, including account management, scheduling workflows, notifications, security monitoring, customer support, and legal compliance.

We do not use customer personal data for unrelated advertising or sell personal data to third parties.

4. Data Sharing and Disclosure

We may share information with:

  • Service providers supporting hosting, messaging, payment processing, and support operations.
  • Customer-authorized users within the same customer account context.
  • Regulators, courts, or law enforcement where required by law.

All sharing is limited to what is necessary for the stated purpose.

5. Clickwrap and Agreement Records

When an authorized representative submits an order form, Shift Elevate records clickwrap acceptance details (including timestamp, submitted legal entity name, and related technical log details) to support contractual evidence and operational review.

These records are retained in accordance with our internal retention and legal hold obligations.

6. Security and Retention

We apply reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction.

We retain personal information only as long as needed for service delivery, customer support, and legal or regulatory obligations.

7. Rights and Requests

Depending on applicable law, individuals may request access, correction, deletion, or export of personal information. Customer administrators can also manage user records directly within Shift Elevate.
