1. Acceptance of Terms
These Terms of Service ("Terms") govern access to and use of Shift Elevate services, websites, and related tools. By accessing or using the service, you agree to these Terms and our Privacy Policy.
If you accept on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility and Account Access
You must be authorized by your organization to use Shift Elevate. You are responsible for maintaining the confidentiality of credentials and for all activity under your account.
You will promptly notify your administrator or Shift Elevate support of suspected unauthorized access.
3. Permitted Use
You may use Shift Elevate only for lawful business purposes related to staffing, scheduling, and internal operations. You agree not to misuse the platform or attempt to disrupt service performance.
- Do not bypass security controls or access data without authorization.
- Do not upload malicious code, spam, or unlawful content.
- Do not copy, resell, or reverse engineer the service.
4. Service Availability and Changes
Shift Elevate may update functionality, user experience, and integrations over time. We may perform maintenance that temporarily affects availability and will use reasonable efforts to minimize disruption.
We may suspend access when necessary to protect platform security, prevent misuse, or comply with law.
5. Intellectual Property
Shift Elevate and related branding, software, and documentation are owned by Shift Elevate or its licensors and protected by applicable intellectual property laws.
Except for limited use rights expressly granted, no additional rights are transferred to Customer or users.
6. Suspension and Termination
Shift Elevate may suspend or terminate access for violation of these Terms, non-payment by the subscribing customer, or legal or security requirements.
Upon termination, your right to use the service ends immediately, and surviving obligations (including confidentiality and liability provisions) remain in effect.
7. Disclaimers and Limitation of Liability
Except as expressly set out in a signed agreement, Shift Elevate is provided "as is" and "as available." To the fullest extent permitted by law, Shift Elevate disclaims implied warranties.
Shift Elevate is not liable for indirect, incidental, special, consequential, or punitive damages arising from service use.
8. Governing Law and Contact
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws rules. Any disputes will be resolved in competent courts located in Utah unless otherwise required by law.
